User Agreement for Smart Devices.
This is an agreement between you and Hamilton Housewares Pvt. Ltd.
Before using device App, please read these 1. Terms of Use, 2. Privacy Policy statement available through your Device App, or provided with Device Enabled Products (collectively, this "Agreement"). By using Device App, you agree to be bound by the terms of this Agreement. If you do not accept the terms of this Agreement, then you may not use device app and website. You acceptance of this Agreement grants you a revocable, non-exclusive, non-transferable, limited license to download, install, and use the Mobile App for your personal and internal business purposes strictly in accordance with this Agreement and the Subscription.
For the purpose of this Agreement:
- "Device" means products sold by Hamilton Housewares under its brands (Milton, Treo, Claro, Spot Zero)
- "Website & App" means the app or website provided by Hamilton and its brands that provides access to Device, Device's settings, Device-related content, and other information and includes Third Party Services, digital content, Software, the Device App, and support and other related services.
- "Device Enabled Product" means any product or application that enables access to Device, such as Hamilton and its brand’s devices and the Device App.
- “Device Interactions” means all information related to your use of Device and Device Enabled Products, including your voice and other inputs, responses provided to you through Device, information we receive in connection with Third Party Services and Auxiliary Products you use, and information and content you provide or receive through the Device App.
- “Auxiliary Product” means any product you can interact with or operate using any Device Enabled Product, including Device Gadgets and smart home devices such as, Mobiles, Voice command enable speaker like Alexa, Eco.
- "Software" means all computer program and computer software that we make available to you for use in connection with Device in form of an App.
- "Third Party Service" means any service or application provided by a third party that we make available to you for use on or through Device.
Terms of Use
- All content (texts, trademarks, illustrations, photos, graphics, files, designs, arrangements, Device etc.) on website, App and of products of Hamilton Housewares and its brands are protected by copyright and other Intellectual property laws.
- Without the explicit written permission of the Hamilton Housewares it is prohibited to integrate in whole, or in part, any of the protected contents published on these websites, Apps or products into other programs or other web sites apps or to use them by any other means. This website and apps contain elements that are protected by copyright and by Intellectual property Laws.
- Hamilton Housewares may deploy changes, updates, or enhancements to the App at any time. Hamilton Housewares may provide maintenance and support for the App until the warranty period, but has no obligation whatsoever to furnish such services to you and may terminate such services at any time without notice after the warranty period of the product.
- You acknowledge that neither Apple (for iOS Mobile App) nor Google (for Android Mobile App) has an obligation to furnish any maintenance and/or support services in connection with the App.
- You agree that you will not use or encourage others to use the Mobile App in a way that could harm or impair others’ use of the App. Your use of the Subscription Service and the Mobile App is governed by the Acceptable Use Policy
- iOS Application. In the event of Hamilton Housewares failure to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price for the Mobile App. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, APPLE WILL HAVE NO OTHER WARRANTY OBLIGATION WHATSOEVER WITH RESPECT TO (A) THE MOBILE APP AND (B) ANY OTHER CLAIMS, LOSSES, LIABILITIES, DAMAGES, COST, OR EXPENSES ATTRIBUTABLE TO ANY FAILURE TO CONFORM TO ANY WARRANTY.
- Android Application. GOOGLE EXPRESSLY DISCLAIMS ALL WARRANTIES AND CONDITIONS OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES AND CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.
- Hamilton Houseware reserves the right to modify this Agreement. Hamilton Housewares will post the most current version of this Agreement on hamiltonindia.in. If Hamilton Houseware makes material changes to this Agreement, we will notify you via Email. Your continued use of the App after Hamilton Housewares publishes notice of changes to this Agreement indicates your consent to the updated terms.
PRIVACY POLICY STATEMENT
Your use of the App requires that you to register and provide private information about yourself and agree to the terms of the Agreement.
1. Collecting personal information
- We may collect, store and use the following kinds of personal information:
- Information about your computer / Mobiles and about your visits to and use of this App (including your IP address, geographical location, phone type, and version, operating system, referral source, length of use);

We may collect certain information automatically through our websites, products, services or other methods of analysis, such as your Internet protocol (IP) address, cookie identifiers, mobile carrier, mobile advertising identifiers, MAC address, and other device identifiers that are automatically assigned to your computer or device when you access the Internet, browser type and language, geo-location information, hardware type, operating system, Internet service provider, pages that you visit before and after using the services, the date and time of your visit, the amount of time you spend on each page, information about the links you click and pages you view within the services, and other actions taken through use of the services such as preferences.

Location Information: When you use location-based program services or features, we may collect your location information such as your GPS information, tracing data, longitude and latitude through your mobile phone device when app is in use or not in use.

Milton App requires location data to switch ON the smart device based on the user's current location ( Welcome Home Mode ) and for Bluetooth connectivity with smart device.
We collect location information for the purpose mentioned above. This data is collected when the app is in use as well as not actively used.
- Information that you provide to us when registering with our App (including your Name, Email, Phone, location);
- Information that you provide to us when using the services on our website App & devices, or that is generated in the course of the use of those services (including the timing, frequency and pattern of service use);
- Information relating to any purchases you make of our goods or any other transactions that you enter into through our website (including your name, address, telephone number, email address and card details)
- Information contained in or relating to any communication that you send to us or send through our website & App (including the communication content and metadata associated with the communication);
- Any other personal information that you choose to send to us;
- Before you disclose to us the personal information of another person, you must obtain that person’s consent to both the disclosure and the processing of that personal information in accordance with this policy.
2. Using personal information
- Personal information submitted to us through our website, App & devices will be used for the purposes specified in this policy or on the relevant pages of the website.
- We may use your personal information to administer our website, App and business;personalise our website, App and business for you; enable your use of the services available on our website & App;
- supply to you services purchased through our website & App;

- send you email notifications that you have specifically requested;

- deal with enquiries and complaints made by or about you relating to our website & App;
- Keep our website secure and prevent fraud;
- Verify compliance with the terms and conditions governing the use of our website, App and device;
- If you submit personal information for publication on our website, we will publish and otherwise use that information in accordance with the license you grant to us.
- We will not, without your express consent, supply your personal information to any third party for the purpose of their or any other third party’s direct marketing.
3. Disclosing personal information
- We may disclose your personal information to any of our employees, officers, insurers, professional advisers, agents, suppliers or subcontractors insofar as reasonably necessary for the purposes set out in this policy.
- We may disclose your personal information to any member of our group of companies (this means our subsidiaries, our ultimate holding company and all its subsidiaries) insofar as reasonably necessary for the purposes set out in this policy.
- We may disclose your personal information:
- to the extent that we are required to do so by law;

- All electronic financial transactions entered into through our website will be protected by encryption technology.
- You acknowledge that the transmission of information over the internet is inherently insecure, and we cannot guarantee the security of data sent over the internet.
- You are responsible for keeping the password you use for accessing our website & App confidential; we will not ask you for your password (except when you log in to our website).

- You may instruct us to provide you with any personal information we hold about you; provision of such information will be subject to:
- The payment of a fee (currently fixed at INR 500); and
- The supply of appropriate evidence of your identity (for this purpose, we will usually accept a photocopy of your passport certified by a solicitor or bank plus an original copy of a utility bill showing your current address).
- We may withhold personal information that you request to the extent permitted by law.You may instruct us at any time not to process your personal information for marketing purposes.
- In practice, you will usually either expressly agree in advance to our use of your personal information for marketing purposes, or we will provide you with an opportunity to opt out of the use of your personal information for marketing purposes.
9. Third party websites
- Our website & App includes hyperlinks to, and details of, third party websites.
- We have no control over, and are not responsible for, the privacy policies and practices of third parties.
10. Updating information
- Please let us know if the personal information that we hold about you needs to be corrected or updated.
- Our analytics service provider generates statistical and other information about website and App.
- The information generated relating to our website & App is used to create reports about the use of our Website and App.
